Curaçao Cracks Down on Online Casinos for KYC Violations

Landmark Settlement Sets Legal Precedent
In a landmark enforcement move, the Public Prosecutor’s Office (PPO) of Curaçao, in collaboration with Sint Maarten and the Caribbean Netherlands, has reached an out-of-court settlement with twelve online casino operators. These platforms were found to be non-compliant with mandatory identity verification laws, violating Curaçao’s client identification regulations. This marks the first time Curaçao’s online gaming sector has faced legal consequences for breaches of Know Your Customer (KYC) protocols frameworks designed to combat fraud, money laundering, and protect vulnerable users, including minors.
Operation Nebraska Uncovers Widespread Breaches
The investigation, code named Nebraska, was initiated after public complaints and media exposure driven by the Foundation for Representation of Victims of Online Gaming. Authorities reviewed 17 gambling websites and concluded that players were able to create casino accounts and deposit funds without proper ID checks, a clear breach of local legislation requiring identity confirmation prior to any financial interaction.
Financial Penalties Imposed, One Operator to Face Trial
While the 12 companies involved agreed to the settlement terms, they did not formally acknowledge guilt or accept criminal responsibility. Eleven operators paid fines of XCG 22,500 ($12,570) per site, amounting to a collective total of XCG 360,000. However, one operator failed to comply, voiding the settlement and now faces legal prosecution.
